Although you should never lie or argue with a police officer, you do have the right to ask why you were stopped, or why you are being arrested. If the officer is not in uniform, you have the right to request that the officer produces his or her badge.
Customs and immigration officers from the Canada Border Service Agency (CBSA) are also considered “peace officers” and have all of the powers of arrest of a police officer, so the same considerations that govern interactions with police officers apply – with one important exception. You are required by law to truthfully answer all questions from a CBSA officer. Failure to be truthful may result in you being charged with misrepresentation.
Sometimes our legal team will offer you legal advice, pertaining to a past or potential arrest. For example, if you have been charged with a failure to appear, the courts will more than likely issue a warrant for your arrest. Since you were not in court, you may not be aware of that arrest warrant. If you believe you could have a warrant outstanding against you, you can contact us and we will check with the courts. If we discover there is a warrant, we will do our best to try and get that warrant dropped; if this is not possible, we will work hard to make sure that once you are arrested, you are released as quickly as possible. We will never have you avoid an arrest since it is likely to cause more damage to your case and is against the law to do so.
